First Repeal of a Section of Health Care Reform Going on Now!

Posted on August 4, 2010 by Leasa Magnuson in Business Tax

Remember last week I talked about the new requirement for businesses to file a Form 1099 for services and products to non tax exempt entities including corporations? It is a highly unpopular segment of the Health Care Act that is currently seeing some action from Congress. Both the Democrats and Republicans agree that they would like to repeal this section of the HealthCare Act before it gets enacted into law, probably due to it being an election year more than anything else, but nevertheless a repeal would be in the best interest of small businesses so let’s hope they get their act together.

It would seem like if they are both in agreement then all that needs to be done is a document drafted and a vote taken. Simply enough in the business world, but we ARE talking Congress. The wording has been drafted as follows:

“Section 9006 of the Patient Protection and Affordable Care Act is repealed. Each provision of law amended by such section is amended to read as such provision would read if such section had never been enacted”

Granted it is written in Congressional gobbledygook but you still get the idea that Section 9006 is to be repealed. The real kicker is that it is attached to other junk that both sides are not in agreement on, and so in the first go around it did not pass. Sometime during this week (August 2nd) they will vote on it again.

I think they should start with a simple document addressing just the one issue and then vote on it. Imagine the positive effect it would have on Congress and all us little people if it could be repealed with 100% agreement!
